I was sent a September 9, 2008 letter from the "Senior Manager, Executive Client Relations" with
CIBC Customer Care in Toronto. This was very unusual since I had not yet filed a complaint
regarding my missing $61,000.00 GIC term deposit with CIBC's complaints department. As
expected, CIBC admitted it stole every last penny of my sixty-one thousand dollar investment.
Every penny. All for us, none for you. You need to eat? Too bad says CIBC.
This $61,000.00 theft was executed deliberately and methodically, it was planned carefully and
thought out well in advance. The Powell River, BC CIBC branch manager waited patiently until my
GIC term deposit matured and then as soon as the interest payment was remitted and the locked-in
investment became available for redemption he redeemed the investment himself and deposited it in
a CIBC bank account. That is theft. CIBC's act of redeeming a client's privately-owned investment
and depositing it in a CIBC bank account is a serious act of fraud. It's my understanding the
investment could only be lawfully redeemed by me, the registered owner, but apparently the Powell
River, BC CIBC branch manager has extraordinary powers. Not only does he have complete
discretion to access private bank accounts, he also has authority to redeem privately-owned GIC
term deposits without facing any obstacles whatsoever. However, to lawfully confiscate a client's
cash a bank employee would require a power of attorney on the client or a court judgment. If
CIBC is of the belief it has grounds to confiscate my privately-owned third party funds CIBC must
undertake an application in a court of law for a legal judgment with specific directions for CIBC to
follow. If CIBC wants to lawfully appropriate my GIC term deposit CIBC has to sue me in a court
of law.
Attached to the letter were multiple copies of a bank draft drawn on a Powell River, BC CIBC bank
account paid to the Receiver General in the amount of $60,821.08. CIBC deposited all of my
money into a CIBC bank account and then remitted a bank draft from their account to the Receiver
General. One of the copies appeared to have been taken from an Internet web page. For some
reason CIBC posted a copy of their bank draft on the Internet.
Of course the letter from CIBC Customer Care amounted to a confession to abominable acts of
crime - criminal fraud and criminal theft over $5,000.00 and criminal conspiracy to defraud a bank
customer. The letter was conclusive hard proof of a criminal investment fraud scheme and
conclusive hard proof of a criminal conspiracy to commit fraud. CIBC falsely claimed it was
instructed to seize and remit my $61,000.00 to the government pursuant to a CRA Requirement to
Pay order. CIBC was lying. In actual fact there is no Requirement to Pay order that instructs
CIBC to remit $61,000.00 - or any other amount - to the Receiver General from my GIC term
deposit account.
Also attached to the confession was a copy of a June 18, 2008 Canada Revenue Agency
Requirement to Pay form issued to the Powell River, BC CIBC branch manager by the same
Vancouver, BC CRA animal who has been doggedly stalking me since 2006. The Requirement to
Pay form was a plain message from the Government of Canada to CIBC instructing the bank to
kick me as hard as it possibly could. And that is what CIBC did. The Requirement to Pay form is
conclusive hard proof of a criminal bank fraud scheme and conclusive hard proof of a criminal
conspiracy to defraud a bank customer. It's this form that CIBC falsely claims gives them authority
to plunder every last penny of cash I held at CIBC. According to CIBC, this document allows
CIBC to confiscate everything from my savings account and from my personal bank account too.
Everything. But all you have to do is read the instructions on the document to see that CIBC is
lying and is using the form as an excuse to maliciously rip off a customer. According to the form,
the only funds eligible for remittance to the Receiver General are the payments I receive from the
Powell River, BC branch of Canadian Imperial Bank of Commerce. And I've never received a
payment from the Powell River, BC branch of CIBC. I didn't even receive the interest payment on
my GIC term deposit. I was supposed to receive an interest payment on my GIC term deposit
investment but I didn't receive the payment. By the time the interest payment was remitted CIBC
had already seized all my accounts, including the GIC account. That interest payment wasn't paid
to me, it was paid to the bank. The interest on my investment was immediately seized by the bank
when it was remitted. So that payment would hardly be considered eligible for remittance since it
was paid to CIBC, not to me. CIBC paid my interest payment to themselves.
I was kept completely in the dark by the federal government with respect to this unlawful seizure.
Canada Revenue Agency did not serve me with a copy of the Requirement to Pay form. The illegal
confiscation of my CIBC GIC term deposit and my CIBC personal bank account was done in
secret, conspiratorially behind my back.
The remittance of the form to a third party like the manager of a Powell River, BC branch of CIBC
represents an extremely serious illegal breach of my personal privacy. The form reveals my name,
it reveals my tax account number, it reveals a debt CRA claims I owe the government, and it reveals
a private and confidential mailing address (now abandoned due to the overwhelming amount of
fraud/stalker mail I was receiving from Vancouver, BC lawyers and government officials) that has
never been disclosed to CIBC. CRA had no legal right to disclose my private mailing address to
CIBC.
The actions of CRA and CIBC regarding this theft have been exceedingly sinister. Neither of them
can be trusted. They have no credibility and aren't capable of conducting themselves lawfully. First
CIBC attempted to conceal this theft. CIBC was determined to hide the theft from me. CIBC had
no intention of remitting any information or paperwork regarding the missing sixty-one thousand
dollars, they were going to keep it a secret. Once the Government of Canada made contact with the
bank I was abandoned, CIBC didn't see me as a client any longer. Had I not aggressively badgered
CIBC for information no information would have been released, the theft would have remained
hidden. CIBC was going to maintain their silence and attempt to cover up their massive fraud by
keeping their mouths shut. In the Italian Mafia there's a word for this nature of criminal conduct:
the word is omertà, the cooperative code of silence among mafiosi. The information CIBC finally
released amounted to a confession to a massive act of fraud. And CRA has released no information
regarding the confiscation of my CIBC accounts at all.
Don't bother filing a complaint, CIBC Customer Care stated. CIBC informed me it will not accept a
complaint regarding this massive theft of tens of thousands of dollars from my GIC account. CIBC
Customer Care instructed me to contact Canada Revenue Agency should I wish to receive any
information regarding this theft of my privately-owned funds. Call the federal government if you
want to discuss this colossal bank theft with someone, don't call us, said CIBC. The government
takes complaints from bank customers? When did that start? Why would CIBC suggest I contact
the federal government about a bank theft? CIBC has a government legislated internal dispute
resolution process in place for customer complaints. My GIC investment has nothing to do with the
Government of Canada. Nothing at all.
Moreover, this sleazy CIBC Customer Care letter was issued to me at the prompting of the Powell
River, BC CIBC branch manager. I had not yet reported the GIC theft to CIBC Customer Care in
Toronto, Ontario when I received CIBC's deplorable September 9, 2008 confession. I didn't lodge
a complaint regarding the GIC term deposit theft with CIBC Customer Care until September 29,
2008. This was a dirty preemptive cover-up move by the Powell River, BC CIBC branch manager
to hide his misconduct. The branch manager improperly interfered with CIBC's internal dispute
resolution process. The branch manager's communications with CIBC's customer complaints
department were for the purpose of unfairly biasing CIBC Customer Care in the manager's favor.
CIBC Customer Care prejudged the case in CIBC's favor and told me to take my complaint (a
complaint that hadn't yet been filed with them) elsewhere, to the federal government. I'd been told
to get lost. Yet according to CIBC's dispute resolution process (which is the same at all other
banks), it is the victimized client who files the complaint with CIBC Customer Care, not the branch
manager guilty of putting $61,000.00 of a client's cash in a CIBC bank account. The Powell River,
BC CIBC branch manager isn't the burned CIBC customer. I am.
Then, more than two months after redeeming my investment and pocketing my cash, the CIBC
branch manager himself finally ended his silence and issued a statement in response to the telephone
messages I left for him and the CIBC employee who sold me the investment. I received a terse
September 22, 2008 letter from the manager admitting that he paid the proceeds of my GIC term
deposit to the government on July 15, 2008. He instructed me to contact the federal government
should I wish to lodge a complaint about this theft of my money. His letter amounted to a
confession to a serious act of criminal fraud. I never did receive a response of any kind from the
"Financial Services Representative" who sold me the GIC investment in 2007. She simply
disappeared.
I reported the CRA-Canadian Imperial Bank of Commerce $61,000.00 rip-off to the police in an
October 7, 2008 complaint. On October 21, 2008 I filed a complaint with the Privacy
Commissioner detailing Canada Revenue Agency's contact with my mother and CRA's instigation of
thefts from my accounts at CIBC. Copies of the criminal and privacy complaints were sent to the
Prime Minister himself.
Then, as had happened in June, Canada Revenue Agency was compelled to retaliate. Six days after
filing the complaints I was visited at my home by two federal government thugs.
